1. Acceptance and Scope
These Terms and Conditions ("Terms") govern your use of the ZYLX website at www.getzylx.io (the "Website") and the ZYLX text message program described in Section 3. The Website and program are
operated by Nextpro Technologies, Inc., doing business as ZYLX ("ZYLX," "we," "us," or "our"). By using the Website or providing your mobile number to receive ZYLX text messages, you agree to these Terms. Use of the ZYLX mobile application, access control platform, and credentials is governed by the ZYLX End User Terms of Use. Organizations that purchase ZYLX are governed by their customer agreement with ZYLX. How we handle personal data is described in our Privacy Policy.
2. Use of the Website
The Website provides general information about ZYLX products and services. Content may change without notice and is not a binding offer. If you submit information through the Website, you agree that
it is accurate and that you are authorized to provide it. You agree not to use the Website unlawfully, attempt to gain unauthorized access to it or any connected system, introduce malware, or scrape or overload it with automated requests. Links to third-party websites are provided for convenience, and we are not responsible for their content or practices.
3. SMS / Text Messaging Program
Program description. ZYLX sends text messages to End Users containing their mobile door access links and related access notifications, such as credential activation, access changes, and account or security alerts. Messages are transactional only. We do not send marketing or promotional text messages. How you opt in. You opt in by phone. When you call your building's ZYLX administrator to request mobile door access, the administrator reads you a consent disclosure. Your number is entered and messages are sent only after you verbally agree, and your consent is recorded with the date and time. Message frequency. Message frequency varies based on your access activity and account changes. Costs. Message and data rates may apply. ZYLX does not charge for text messages.
Opting out. Reply STOP to any ZYLX message to cancel at any time. You will receive one final confirmation message and no further messages will be sent. To rejoin, contact your building's ZYLX
administrator. Help. Reply HELP to any ZYLX message, or email admin@getzylx.io. Carriers. Mobile carriers are not liable for delayed or undelivered messages. Privacy. We do not sell, rent, or share mobile phone numbers or SMS opt-in consent with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy.
4. Intellectual Property
The Website and its content, including text, graphics, logos, and the ZYLX® trademark, are owned by Nextpro Technologies, Inc. or its licensors. You may view the Website for personal, non-commercial use. You may not copy, modify, or distribute its content or use our trademarks without our prior written consent.
5. Disclaimers and Limitation of Liability
THE WEBSITE AND TEXT MESSAGE PROGRAM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT TEXT MESSAGES WILL BE
DELIVERED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZYLX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR TEXT MESSAGE PROGRAM, AND OUR TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow these limitations, so they may not apply to you.
6. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles, except where mandatory local law requires otherwise. If any provision is
found unenforceable, the rest remain in effect.
7. Changes and Contact
We may update these Terms from time to time by posting a revised version on this page with a new effective date. Continued use of the Website or text message program after a change means you accept
